1. Welcome & Purpose

Thank you for choosing BrainRevive Clinics (BRC). This document explains important safety information, your responsibilities, and legal terms that apply when you purchase and use a mild Hyperbaric Oxygen Therapy (mHBOT) chamber for home use. Please read carefully before completing your purchase.

By checking the box at checkout, you confirm that you have read, understood, and agree to all terms in this agreement.

2. What Is mHBOT?

mHBOT involves breathing ambient or enriched air inside a pressurized soft or hard chamber, typically at pressures up to 1.3–1.5 ATA. It is used by consumers for wellness, recovery, and general well-being. It is not a medical treatment unless prescribed and supervised by a licensed physician for approved indications.

3. Important Safety Notice — Not Medical Advice

• BRC does not provide medical advice, diagnosis, or treatment recommendations through this website or product sale.
• You are responsible for consulting your physician or qualified healthcare provider before using an mHBOT chamber, especially if you have any medical conditions, take medications, or are pregnant.

4. Absolute Contraindications — Do Not Use If

The following are widely recognized as absolute contraindications for hyperbaric oxygen exposure. If any apply to you, do not use this chamber unless cleared in writing by your physician:

• Untreated pneumothorax (collapsed lung) — This is life-threatening under pressure changes.
• Recent eye surgery with intraocular gas bubble (e.g., C₃F₈, SF₆) — Risk of blindness from pressure changes.

5. Relative Contraindications & Precautions — Consult Your Doctor First

The following conditions may increase risk. Use only after medical clearance and appropriate precautions:

• Lung conditions: COPD, emphysema, cystic fibrosis, asthma, pulmonary blebs/bullae — Risk of air trapping or pneumothorax.
• Recent ear, sinus, or thoracic surgery or injury — Risk of barotrauma.
• Active upper respiratory infection, sinusitis, or fever — Increases ear/sinus pressure injury risk and seizure threshold concerns.
• History of seizures or epilepsy — Oxygen exposure may lower seizure threshold.
• Pregnancy — Safety not established except in emergency CO poisoning under medical care.
• Implanted devices: Pacemakers, epidural pumps, cochlear implants — Must be pressure-tested by manufacturer.
• Recent chemotherapy or specific medications: Bleomycin (avoid indefinitely unless cleared), doxorubicin (wait ≥24–72 hours), cisplatin (impairs wound healing), disulfiram (increases oxygen toxicity risk), sulfamylon/mafenide acetate.
• Severe claustrophobia — May prevent safe or tolerable use.
• Uncontrolled heart failure (EF <35%) — Risk of hemodynamic overload.

6. Known Risks & Side Effects

Even with proper use, side effects may occur. Common and rare risks include:

• Ear or sinus pain, eardrum rupture
• Temporary vision changes or cataract progression with extended use
• Oxygen toxicity seizures (rare)
• Lung barotrauma or pneumothorax (especially with underlying lung disease)
• Claustrophobia or anxiety reactions
• Fatigue, headache, nausea

You assume all risks associated with use.

7. Your Responsibilities as the User

By purchasing and using this chamber, you agree to:

• Obtain medical clearance from your physician before first use if you have any health conditions or take medications.
• Read and follow all manufacturer instructions, safety guides, and maintenance requirements.
• Never exceed recommended pressure, session duration, or frequency.
• Stop use immediately and seek medical attention if you experience chest pain, severe ear pain, shortness of breath, vision changes, confusion, or seizure activity.
• Ensure the chamber is used only by the purchaser or individuals medically cleared and supervised by the purchaser.
• Keep the chamber out of reach of children and never allow unsupervised use by minors.

8. No Medical Device Claim — Wellness Product Only

This mHBOT chamber is sold as a wellness and lifestyle product for home use. It is not FDA-approved as a medical device for diagnosis, cure, mitigation, treatment, or prevention of disease unless explicitly stated otherwise in writing by BRC. Any health-related claims made by third parties, influencers, or users do not represent BRC’s position.

9. Limitation of Liability — No Responsibility for Use

YOU ACKNOWLEDGE AND AGREE THAT:

• BRC, its owners, employees, agents, affiliates, and partners (the “Released Parties”) are not responsible for any injury, illness, death, property damage, or loss arising from your purchase, possession, or use of this chamber — whether foreseeable or unforeseeable, including negligence (except gross negligence or willful misconduct where prohibited by law).
• You use the chamber solely at your own risk.
• BRC makes no warranties, express or implied, including fitness for a particular purpose, merchantability, or non-infringement, except as required by applicable law.
• Your sole remedy for any defect is limited to repair or replacement of the chamber under the manufacturer’s warranty, if applicable.

10. Indemnification — You Protect BRC

You agree to indemnify, defend, and hold harmless BRC and its Released Parties from any and all claims, demands, lawsuits, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use or misuse of the chamber
• Any injury or damage to yourself, others, or property
• Any breach of this agreement
• Any claim that your use violated third-party rights or laws

11. Assumption of Risk

You expressly understand and voluntarily assume all risks — known and unknown, foreseen or unforeseen — associated with mHBOT chamber use, including but not limited to:

• Physical injury, illness, or death
• Aggravation of pre-existing conditions
• Equipment malfunction or failure (even if due to manufacturing defect, unless covered under warranty)
• Improper assembly, maintenance, or operation by you or third parties

12. Governing Law & Venue

This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from this agreement shall be brought exclusively in the state or federal courts located in Nevada, and you consent to personal jurisdiction therein.

13. Severability

If any provision of this agreement is found invalid, illegal, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect to the maximum extent permitted.

14. Entire Agreement

This document constitutes the entire agreement between you and BRC regarding your purchase and use of the mHBOT chamber. It supersedes any prior or contemporaneous understandings, whether oral or written.

15. Acknowledgement & Electronic Consent

By checking the box at checkout, you confirm that:

• You are at least 18 years old and have legal capacity to enter this agreement.
• You have read, understood, and voluntarily agree to all terms, warnings, waivers, and indemnities herein.
• You understand this is a legally binding document.
• You consent to receive this agreement electronically and retain a copy for your records.
